Privacy Policy

Meesys Pty Ltd (the “Company”) is committed to complying with the Australian and New Zealand Privacy Principles, governing the collection, use, storage of and access to personal information and sensitive information. We created this privacy policy to demonstrate, to you our users, our firm commitment to privacy. This policy has been prepared in accordance with our obligations and your rights under the Australian Privacy ACt 1988 and the New Zealand Privacy Act 1993 ( including the information privacy principles recorded in section 6 of the New Zealand Privacy Act).

When accessing and using the ScanChats application and other products and applications developed by the Company (the “Applications”), you acknowledge that you will be supplying personal information and sensitive information (in each case, as defined by the Privacy Act 1988 (Cwth) as updated or amended from time to time).

By accessing and using the Applications, you are deemed to have accepted and agreed to the information collection, use and storage practices contained in this Privacy Policy (as maybe updated or amended by the Company as specified below).

This Privacy Policy should be read in conjunction with (and is deemed to be incorporated into) the Company’s standard Terms of Use relating to your access to, and use of, the Applications.

1. PERSONAL INFORMATION COLLECTED

1.1. When you access and use the Applications, you are required (from time to time) to provide personally identifiable information and data. This is a necessary part of your use of the Applications, and so anonymity cannot be maintained. This may include (without limitation) information about you, your children and family names, telephone number and email address that maybe sensitive in nature, (together, “Personal Information”).

1.2. In addition, the Company’s web servers or those provided by the Company’s authorised Internet Service Providers (“ISPs’) and/or Cloud Service Providers (“CSPs”) will collect your Personal Information for the purposes of providing the Application services to you on behalf of the Company. They may also automatically collect Personal Information through the use of “cookies”. Cookies are small text files that are placed on your hard disk by a web page server, which enable websites to recognise repeat users.

1.3. The Company will only store your Personal Information for so long as is necessary (in the Company’s sole opinion) to provide you with the products and services it provides. Unless required to do so by law, the Company will not use your Personal Information for any other purpose – other than for the purposes set out in this Privacy Policy.

1.4. The Company will use reasonable efforts to notify you if it receives Personal Information about you or your family from a third party who is not connected to the Company or your use of the Applications.

2. USE OF PERSONAL INFORMATION COLLECTED

2.1. The Personal Information supplied and collected will be used (in each case, by the Company and/or by its authorised ISPs or CSPs) to:

2.1.1. operate the web browser that facilitates your access to the Applications;

2.1.2. provide the services delivered via the Applications;

2.1.3. carry out and process the transactions you authorise by your use of the Applications;

2.1.4. improve the services offered by the Company;

2.1.5. enable the Company to develop new or improved products and services;

2.1.6. send you update information about the Company, or the products and services it offers (from time to time), but the Company will not knowingly supply your Personal Information to third parties for the purposes of direct marketing;

2.1.7. collate data and information about user base and usage patterns; and

2.1.8. enable the Company to carry out any other lawful act, as required or deemed necessary by the Company.

2.2. Your Personal Information will also be supplied to, and accessible by, third party ISPs and CSPs used by the Company from time to time for the purposes of providing the services offered by the Applications (who may or may not be located in your country). Whilst the Company will take reasonable measures to ensure the safety and security of your Personal Information, the Company is not responsible or liable for any use or storage of, or access to, your Personal Information by any such ISP or CSP or for any breach of the Australian or New Zealand Privacy Principles by any such ISP or CSP.

2.3. Your Personal Information may also be supplied to other third parties (who may or may not be located in your country) in order to improve the products or services offered by the Company.

2.4. By accessing and using the Applications, you are deemed to consent to such third party transfer pursuant to paragraphs 2.2 and 2.3.

2.5. The Company may also be required to disclose or transfer your Personal Information to law enforcement agencies, Government bodies or other authorities, in each case, as maybe required by law.

2.6. The Company will use its best efforts to protect your Personal Information in accordance with this Privacy Policy, but is not responsible or liable to you in the event that your Personal Information is either “hacked” or otherwise accessed by an unauthorised third party.

2.7. All Personal Information is supplied by you at your own risk.

3. ACCURACY OF PERSONAL INFORMATION

3.1. You are at all times responsible for ensuring that the Personal Information supplied by you is accurate, complete and up to date. You are responsible for updating your Personal Information via the Applications.

3.2.The Company will have no responsibility or liability for any false, inaccurate or out of date Personal Information supplied or posted by you or to any other party intended by you to receive your Personal Information.

4. SECURITY

4.1. The Company uses its best endeavours to protect your Personal Information and to store it on secure servers if (and to the extent that) your Personal Information is stored on servers under its control.

4.2.The Company cannot guarantee that your Personal Information will remain secure when stored on the servers of its ISPs or CSPs or that such ISPs and CSPs will have privacy policies that comply with Australian Commonwealth law and NZ Law, but does take reasonable measures to check the integrity of all such ISPs and CSPs.

5. AMENDMENTS TO THIS PRIVACY POLICY

5.1.The Company may amend or update this Privacy Policy from time to time (as it sees fit or as the law may require). Any such amendments or updates will be posted on the Company’s website, and your continued access to, and use of, the Applications will be deemed to be your acceptance of any such changes.

6. ACCESS TO YOUR PERSONAL INFORMATION

6.1. You may request access to, or copies of, the Personal Information that the Company collects as part of the services it provides, but this may not include Personal Information collected, or stored by any ISP or CSP engaged by the Company.

6.2. If requested, the Company will use its reasonable efforts to provide you with the Personal Information it has collected about you, and is entitled to charge you a reasonable fee if your request requires a substantial effort on the Company’s part.

6.3. Any requests for access to your Personal Information or any complaints you may have in connection with this Privacy Policy should be emailed to admin@scanchats.com. The Company will respond to your request or complaint with a reasonable period of time from the date it is received bythe Company.
